Terms of Service
The terms that govern your use of the Omevra website, applications, and API.
These Terms apply from the date they are posted on this page.
These Terms of Service (“Terms”) govern your use of the Omevra website, applications, and API (the “Service”), provided by Umesh Linga, operating as Omevra (“Omevra,” “we,” “us”). By creating an account or using the Service, you agree to these Terms. If you use the Service for an organization, you confirm you have authority to bind that organization.
1. Research use only
The Service is a research tool. It is not a medical device and is not intended for diagnosis, treatment, prevention, or clinical decision-making about any individual. Reports are evidence summaries, not clinical classifications. ACMG/AMP variant classification remains the responsibility of qualified professionals. You must not use the Service’s outputs as the sole basis for any clinical or patient-care decision.
2. Accounts
- You must be at least 18 years old and provide accurate account information.
- You are responsible for keeping your login credentials secure and for all activity under your account.
- Tell us promptly at umesh.linga25@gmail.com if you suspect unauthorized access.
3. Subscriptions and billing
- Paid plans are billed in advance, monthly or annually, through our payment processor.
- Subscriptions renew automatically at the end of each billing period unless you cancel before renewal.
- You can cancel at any time in your account settings. Cancellation takes effect at the end of the current billing period.
- Fees are non-refundable except where required by law or stated otherwise in writing.
- Compute credits are prepaid, do not expire, and are non-refundable.
- We may change prices with at least 30 days’ notice. Changes apply from your next renewal.
- Free trials convert to a paid plan at the end of the trial unless you cancel.
4. Your data
- You own your data. Data you upload (“Customer Data”) remains yours.
- You grant us a limited license to store, process, and display Customer Data only to provide the Service to you.
- We do not sell Customer Data, and we do not use it to train our models without your written permission.
- You may export or delete your Customer Data at any time.
5. Protected health information
You must not upload protected health information (PHI) or other directly identifying personal information about patients or research participants unless you have signed a Business Associate Agreement (BAA) with us. Upload de-identified data only. You are responsible for having all consents and approvals (for example, IRB approval) required to process your data.
6. Acceptable use
You agree not to:
- Use the Service for clinical diagnosis or patient care
- Upload data you do not have the right to use
- Reverse engineer, scrape, or bulk-extract the Service, its models, or its outputs to build a competing product
- Share your account or resell access without our written agreement
- Exceed rate limits, disrupt the Service, or attempt to bypass security controls
- Use the Service in violation of any law
7. Our intellectual property
The Service, its software, models, and design belong to Omevra. Except for your Customer Data and the reports generated for you, these Terms do not transfer any intellectual property to you. You may use reports generated for you in your own research and publications, with appropriate citation of Omevra.
8. Third-party data
The Service uses public and licensed data sources, including ClinVar, gnomAD, and AlphaMissense predictions (© 2023 DeepMind Technologies Limited, used under CC BY 4.0). These sources are subject to their own terms. We do not guarantee their accuracy or completeness.
9. Availability and changes
We aim for high availability but do not guarantee uninterrupted service. We may update, add, or remove features. We will give reasonable notice of changes that materially reduce a paid plan’s functionality.
10. Disclaimer of warranties
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. Predictions are probabilistic and may be wrong.
11. Limitation of liability
To the fullest extent permitted by law, Omevra is not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim.
12. Indemnification
You agree to indemnify and hold Omevra harmless from claims arising from your Customer Data, your misuse of the Service, or your violation of these Terms, including any use of the Service for clinical purposes.
13. Termination
We may suspend or terminate your account if you materially breach these Terms, including uploading PHI without a BAA. You may stop using the Service at any time. After termination, you have 30 days to export your data before it is deleted.
14. Governing law
These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Marion County, Indiana.
15. Changes to these Terms
We may update these Terms. We will post the new version on this page and, for material changes, notify account holders by email at least 30 days in advance.
